Importers arguing for the watch heading, 9102, on the basis that the device is worn and shows the time are rearguing a settled question and should expect to lose it with costs.

Principal function decides, and the notes help

The honest test is subtraction. Remove the communication function and a smartwatch is a dim screen with sensors. Remove the time display and it loses nothing it is sold for. That asymmetry is the principal function argument in one paragraph, and it is why the marketing, which sells notifications, calls, apps, and connectivity, agrees with the tariff answer even when the invoice calls the product a watch.

A dedicated heart rate monitor, a medical grade ECG device, or a GPS instrument whose communication is a minor upload feature can belong with the measuring and medical instruments of chapters 90, because there the measurement is the product and the radio is plumbing. Fitness bands split on the same line: a band built around communication and an app platform follows the smartwatch analysis, while a simple pedometer band with a clock can fall to the instrument or even the watch provisions depending on construction.

Where wearables leave 8517

The file that wins these arguments is a function inventory: every function the device performs, which ones the marketing leads with, which ones work standalone, and which need the radio. Write it at product setup. Reconstructing it during a classification review, from a datasheet and memory, produces exactly the vagueness reviewers are paid to disbelieve.

A watch sold with a strap and charger in one retail box is generally presented as a set or as a device with accessories, and the device gives the whole its essential character, so the box follows the device. Straps and chargers entered separately are their own articles: straps with the watch strap provisions or by material, chargers as static converters in heading 8504. Importers who bring replacement straps in bulk and enter them as parts of smartwatches are borrowing a classification the goods do not have.

Replacement and premium straps are a quiet margin line in this category and a common audit catch for exactly that reason. Classify the strap programme on its own facts, material by material, and keep it out of the device file. The audit that finds strap entries will look at the device entries next, and a clean device file is worth more than the rate difference ever was.

Wearables from the origins most supply chains use attract close attention under additional duty programmes, and the 8517 line a smartwatch sits on can carry a very different additional rate from the line next to it. That makes the national subheading, not just the heading, a number worth a ruling where volumes justify it, and it makes origin, where the device was made or last substantially transformed, a fact to document rather than assume from the shipping port.

This category has an active rulings history and trade measures that shift, and a classification memo written two years ago may describe a landscape that has already moved.
