Classify LED grow lights and horticultural lamps: heading 9405 against 8541 and the parts trap

Describe the imported article before reaching for a heading: is it a finished fixture with housing, optics, and a power supply, a light engine board with diodes mounted, loose diodes, or a kit of parts that only becomes a fixture after assembly. The General Rules of Interpretation work on that article, and an incomplete or unassembled article that has the essential character of the finished fixture can follow the fixture. A box of genuinely separate components cannot borrow the fixture's heading out of convenience.

Start with what crosses the border

Grow marketing does not classify the goods. Words like horticultural and full spectrum describe the buyer, not the article's construction, and classification turns on objective characteristics: what it is made of, how it works, what it does as imported. Keep the spec sheet, the bill of materials, and photographs of the imported condition in the classification file. Those three documents answer most of the questions a ruling request or a CBP review will ask.

Complete electric luminaires and lighting fittings are addressed in heading 9405, which now carries specific provision for LED light sources and their fittings in its structure. Light emitting diodes themselves are semiconductor devices under heading 8541 when imported as diodes, and electrical machines with an individual function can pull an analysis toward Chapter 85 for specialised equipment. The contest is usually between the luminaire reading and the component reading, and it is decided by completeness and essential character, not by which duty rate the importer prefers.

The headings in play, and how the argument runs

Agricultural use does not by itself move a lamp into agricultural machinery headings. A machine heading needs the article to do agricultural work as a machine, not simply to be used by growers. Arguments that reach for a use based heading to escape the luminaire analysis need strong legal support, ideally a binding ruling on facts like yours, because CBP reads use claims against the article's design.

Replacement drivers, hangers, dimmers, and boards imported separately are classified as parts on their own facts, and a part suited solely or principally to a luminaire generally follows its own provision rather than inheriting a rate the importer hoped for. Sellers who split a fixture across two shipments to manage freight should classify each shipment as presented. Splitting does not create a kit, and presenting split shipments as one article is the kind of arrangement that draws a focused review.

Parts, kits, and the second shipment problem

Where the volume justifies it, a binding ruling from CBP on your exact product, with samples and the full bill of materials, is worth its waiting time. A ruling binds the analysis to your facts and survives staff changes at your broker. A screenshot of a competitor's import record binds nothing, including the competitor.

Once classified, apply the duty stack honestly: the MFN rate for the subheading, any Section 301 additional duties where the origin and list cover the code, and any other applicable measures. Grow lights from common manufacturing origins have sat inside trade remedy discussions in recent years, so check the current additional duty position for your code and origin with your broker at the time of entry, not from a saved forum answer. Classification chosen to dodge a stacked rate is the fact pattern penalties are written for.

Stack the duties after the heading, not before

Frequently asked questions

Is a massage gun a medical device for customs purposes?

A complete fixture is generally analysed as a luminaire on its construction, not as farm machinery on its buyer's use. Use can matter in some headings, but it does not convert a lamp into agricultural machinery by itself.

How are foam rollers and manual massage tools classified?

Classify each shipment as imported. Components and parts have their own provisions, and an unassembled article only follows the finished good where it has its essential character under the interpretation rules. Get broker advice or a ruling for your kit structure.

Does a heating function in the head change the classification?

A full spec sheet, bill of materials, photographs of the imported condition, and a note of what is and is not included in the shipment. Those facts, not the marketing name, drive the heading analysis.

What about massage chairs?

At meaningful volume, yes. A ruling on your exact article settles the heading for your entries and documents reasonable care. Broker opinions help, but a ruling is the evidence that survives an audit.
