Classifying lithium ion battery packs: heading 8507 and its Chapter 99 shadow

The ruling's battery was an eight cell rechargeable lithium ion pack, nominal 14.4 volts and 99.36 watt hours, in a plastic enclosure with an LED indicator, a power jack, and a connector specific to one portable oxygen concentrator. CBP still classified it as a battery, not as a part of the medical device, because heading 8507 describes the article itself: an electric storage battery. The device specific connector shaped the product's market, not its heading.

Start with the article as imported

That is GRI 1 doing its ordinary work. Classification follows the terms of the headings and the section and chapter notes before it follows the story of what a product plugs into. Importers who classify by the host product's heading, a medical instrument line in this case, build the whole entry on the wrong chapter and then argue duty rates for a line that was never theirs.

The same ruling classified the rest of the shipment item by item: the AC and DC power supply adapter went to 8504.40.9520 as a static converter, power cords to 8544.42.9090, and the cart to 8716.80.5090. One purchase order, one carton set, four classifications. Kits and bundles do not pull their components into a single heading unless the set rules genuinely apply, and assuming they do is a recurring source of under and over payment in both directions.

Separate articles in one shipment get separate lines

For battery powered products, the practical split is between the battery as a distinct article, a battery sold inside a device as part of that device's classification analysis, and a charger or power supply travelling with either. Each has its own heading logic. The time to draw those lines is on the classification worksheet, with the physical contents of the retail package listed, not at the entry summary with a truck at the port.

Now price the ruling's stack. Base duty 3.4 percent under 8507.60.0020. Chapter 99 heading 9903.01.24 added 20 percent for products of China under the emergency authority note the ruling cited. Note 20 to Subchapter III added a further 7.5 percent Section 301 duty under 9903.88.15 for the same subheading. A buyer comparing suppliers on the 3.4 percent line alone missed roughly eight times that amount sitting in the shadow lines.

The Chapter 99 shadow is bigger than the heading

Rates and notes change, and a ruling states the law as of its issuance, which is why the ruling itself warns that the HTSUS is amended periodically and reasonable care means monitoring the Chapter 99 notes attached to your subheadings. The habit to build is mechanical: every classification worksheet for a China origin electrical product carries a Chapter 99 section, filled in from the current schedule, never copied from last year's worksheet.

Battery files should record the facts rulings actually cite: cell chemistry, cell count, nominal voltage, capacity in amp hours and watt hours, enclosure and connector details, and what the pack is designed to power. Those specifics decide subheading lines inside 8507 and they are the first thing a ruling request or a CBP inquiry will ask for. A file that says only rechargeable battery pack forces the analysis to start again from the product, if the product is even still available.

Watt hours and chemistry belong in the file

Safety documentation travels nearby but does different work. Transport testing and lithium battery handling rules govern how the pack ships, not how it classifies, and mixing the two files produces entries supported by certificates that answer questions nobody at CBP asked. Keep the classification file clean: description, specifications, heading analysis, Chapter 99 notes, and the ruling or worksheet that ties them together.

Frequently asked questions

What heading covers a standalone lithium ion battery pack?

Heading 8507, electric storage batteries. In the ruling example, an eight cell rechargeable lithium ion pack for a medical device classified at 8507.60.0020 with a general rate of 3.4 percent. The pack classified as a battery in its own right, not under the host device's heading, because classification follows the article as imported.

Why did the battery ruling list two Chapter 99 headings?

Because two separate additional duty authorities applied to the same China origin subheading: an emergency authority line under heading 9903.01.24 at 20 percent, and a Section 301 line under 9903.88.15 at 7.5 percent. Each is reported in addition to the 8507 line at entry. That is tariff stacking in its standard form, and it is why the base rate alone misprices the product.

Does a battery inside a device classify the same way?

Not automatically. A battery imported as its own article, a battery sold as a replacement part, and a battery installed in a finished device are three different classification problems. The analysis depends on how the merchandise is presented at import and the relevant chapter notes. Draw the line on the worksheet per product configuration, not by habit.

What specifications should a battery classification file hold?

Chemistry, cell count, nominal voltage, capacity in amp hours and watt hours, enclosure and connector details, and the equipment the pack is designed to power. Those are the facts rulings cite when placing a pack inside heading 8507, and they are what CBP will request if the classification is ever questioned.
