LED lamps, luminaires, and the 8513, 8539, 9405 three way split

Heading 8513 covers portable lamps with their own power source: the flashlight family. In one ruling, a cordless spotlight and a hand held work light landed at 8513.10.4000 at 3.5 percent, while wireless puck lights in the same request went to 9405.40.8000 at 3.9 percent because they were lighting fittings rather than portable lamps carried to the work. Same technology, same ruling letter, different headings, because the articles do different jobs.

Three headings, three different articles

Heading 8539 covers the light source itself, the lamp you screw or plug into a fitting, and its 2017 expansion to LED lamps expressly is what later tempted importers to pull finished decorative products into it. Heading 9405 is the residual home for lamps and lighting fittings as complete articles, including illuminated signs and lighting sets. Most classification errors in this space come from choosing the heading by the bulb technology instead of by the article being imported.

An importer of LED string lights argued for 8543, electrical machines with individual functions, at 2 percent, or for 8539 as LED lamps, duty free. The government argued 9405. The Court of International Trade sided with the government in August, holding the string lights were lighting sets of a kind used for Christmas trees under 9405.30, at 8 percent, and citing Federal Circuit precedent that 8543 should not be read so broadly as to swallow every electric lamp.

The string lights case drew the boundary

The reasoning generalises. A finished decorative lighting product, sold to illuminate a home or a tree, is a lighting article, not a light source component and not a machine with an individual function that happens to glow. Importers pricing decorative lighting on a duty free 8539 assumption after that decision are not taking a position. They are repeating an argument a court has already answered, in a file CBP can read.

Inside this family, small physical facts carry the classification. A lamp designed to be carried to the task, with its own battery, points one way; a fitting designed to be placed, mounted, or plugged in as part of a room's lighting points another. The DOT-IT protest history shows the grinding reality: one small battery LED light was argued across 8541, 8513, and 9405 headings over years, because a tap light sits exactly on the portable versus fitting boundary.

Portability is a design fact

Design intent has to be evidenced, not asserted. Packaging showing the product mounted under a cabinet, instructions describing permanent placement, a form that only works sitting on a shelf: those are classification facts that outweigh a product manager's label. Collect them in the file at import, because reconstructing design intent from a discontinued product's marketing archive is nobody's idea of a good quarter.

Lighting ranges often mix all three headings in one catalogue: portable work lamps at 8513 rates, replacement LED lamps under 8539, fittings and decorative sets under 9405 rates before any Chapter 99 layers are added. A blended duty assumption across the range misprices every line in it, overcharging the fittings and undercharging the sets, and the error only surfaces when a single line is examined closely.

Price the family on the split, not the average

Build the worksheet per article type with the heading reasoning stated, including why the neighbouring headings were rejected. That rejection paragraph is the part officers and judges actually read, because it shows the analysis considered the split this product family is known for, instead of landing on a favourable rate and stopping.

Frequently asked questions

What heading covers LED string lights for Christmas trees?

Heading 9405, as lighting sets of a kind used for Christmas trees, subheading 9405.30 at 8 percent in the case the Court of International Trade decided. The court rejected arguments for heading 8543 and for the LED lamp heading 8539, holding that a finished decorative lighting set is a lighting article under 9405.

When does an LED product fall under 8513 instead of 9405?

When it is a portable electric lamp designed to function by its own source of energy, like a flashlight or a battery work light carried to the task. Rulings have placed cordless spotlights at 8513.10.4000 at 3.5 percent, while puck lights designed as fittings went to 9405.40.8000 at 3.9 percent in the same letter. Design and use decide, not the LED itself.

Is heading 8539 duty free for all LED lighting?

No. Heading 8539 covers LED lamps as light sources. Finished lamps, fittings, and decorative sets are classified as complete articles, generally under 9405, or as portable lamps under 8513. Treating every product containing an LED as an 8539 lamp is the exact argument the string lights litigation rejected.

What evidence decides between portable lamp and lighting fitting?

Design facts: whether the article is made to be carried to the work or placed and mounted, its power source, its packaging and instructions, and how it is marketed and sold. Put those in the classification file at import. On boundary products like tap lights, that evidence is the analysis, and collecting it later is painfully hard.
